احتراماً نظر به اینکه نسبت به موضوعات و سوالات مطروحه ذیل الذکر بین دفاتر اسناد رسمی سراسر کشور اختلاف نظر فاحشی وجود دارد خواهشمند است در راستای ارشاد دفاتر اسناد رسمی دستور فرمایید مراتب در کمیسیون حقوقی کانون سردفتران مطرح و نتیجه را کتبا جهت اطلاع این دفترخانه ( دفترخانه 11 مرند ) امر به ابلاغ فرمایید:

سوال اول : نظر به اینکه برخی از دفاتر اسناد رسمی بر خلاف قانون ؛ در تنظیم اسناد وکالت فروش انواع کانتینرها و نیمه یدک ها با اخذ وحدت ملاک از وسایط نقلیه موتوری ؛ انها را مالی فرض کرده و اقدام به اخذ حق الثبت و نیز حق التحریر بر مبنای قیمت اظهاری طرفین می نمایند و برخی دیگر هم بر مبنای وکالت های غیر مالی و کاری عمل نموده و با حق الثبت مبلغ 20000 ریال و حق التحریر 500000 ریال اقدام به تنظیم سند وکالت فروش می نمایند خواهشمند است در مورد هزینه های تنظیم اسناد وکالت فروش نیمه یدک های فوق الذکر اظهار نظر فرمایید .
